PRIMETIME DUPLICATION . THEY CONTAIN VERY IMPORTANT INFORMATION ABOUT
YOUR LEGAL RIGHTS AND OBLIGATIONS, INCLUDING LEGAL LIMITATIONS AND EXCLUSIONS
THAT APPLY TO YOU.
By accepting delivery of any product delivered from PrimeTime Duplication.
("PrimeTime Duplication"), you ("Customer") agree
to be bound by the terms and conditions listed below. You and PrimeTime
Duplication agree that the following terms and conditions are the exclusive
terms governing the sales transaction between Customer and PrimeTime
Duplication. Any attempt to alter, supplement, modify or amend these
terms and conditions by the Customer will be considered a material alteration
of this agreement and, therefore, are null and void. In addition, these
terms and conditions are subject to change at any time, without prior
written notice. Therefore, please check these terms and conditions carefully
each time you place an order with or accept delivery of any goods from
PrimeTime Duplication.
Please carefully read the following terms and conditions which govern
the use of the PrimeTime Duplication website. Your use of the website
and order placement signifies your acceptance of the terms and conditions
set forth below. PrimeTime Duplication reserves the right to change
its policy at any time without prior notice.
Satisfaction Guarantee
PrimeTime Duplication offers high quality products at very competitive
prices. If you are not satisfied with a product, full payment will be
refunded to you. Please refer to the Return Policy instructions.
Privacy Statement
PrimeTime Duplication respects the privacy of its customers. Protecting
your order information is a priority. Any information that is given
to PrimeTime Duplication is considered private and will only be used
in the order process. The information will not be given or released
to any third party. We have a secure server that protects the order
information from unaffiliated outside parties.
PrimeTime Duplication. will use the email address provided for an Email
List that notifies customers of product promotions. PrimeTime Duplication
will gladly remove you from the list upon notification to do so.
Security
PrimeTime Duplication uses the industry-standard Secure Sockets Layer
(SSL) technology to provide encryption which prevents customers' credit
card number, billing, and shipping information from being intercepted,
misused, and altered by a third party.
Product Compatibility Statement
It is strongly suggested that first-time buyers should check the compatibility
of PrimeTime Duplication CD/DVD Media with their existing hardware and
software setup before ordering large quantities.
Payment Method
Domestic Orders
1. Credit Card
PrimeTime Duplication accepts Visa, MasterCard, American Express, Discover,
and PayPal.
Please make sure to give the exact billing address and phone number
that your credit card company has on file for you. If the shipping address
is different from the billing address, please specify this on the on-line
order form or notify a sales representative.
2. Prepaid Cashier's Check or Money Order
- No Personal Checks
PrimeTime Duplication accepts cashier's checks and money orders; however,
the funds must be cleared prior to shipment.
International Orders
Currently, PrimeTime Duplication only accepts wire transfers for international
orders. Please contact a sales representative to obtain factory prices
for wholesalers. Orders can also be placed by fax or email.
Sales Tax
PrimeTime Duplication will automatically charge and retain the applicable
sales tax for all orders.
Shipping Policy
CD/DVD Duplicator orders will be shipped out the next business day for
testing purposes.
FedEx Express Orders must be received by 1:30pm CST in order to be shipped
on the same business day. UPS ground orders require 1 to 2 days of processing
time before products are shipped.
PrimeTime Duplication does not offer shipping via postal service. Due
to UPS/FedEx restrictions, shipping to P.O. Boxes will not be allowed.
Customers will be charged a $10 address correction fee if UPS/FedEx
is unable to deliver a package due to an incorrect address. Another
attempt to deliver the package will be made once the correct address
has been obtained.
*Customers must inform PrimeTime Duplication within 7 days of any physical
damages as a result of shipment in order for a claim to be filed on
the customer's behalf.

FedEx Ground (5-7 business days)
FedEx Priority Overnight (delivery in 1 business day by 10:30am)
FedEx Standard Overnight (delivery in 1 business day by 5:00pm)
FedEx 2 Day (delivery in 2 business days)
FedEx Express Saver (delivery in 3 business days)
Return Policy
Physical damage to any item will void the product's warranty. Physical
damage is defined as altering of the product's physical appearance that
differs from its original state at the time of purchase. Examples of
physical damages are, but not limited to, dents, cracks, chips, burns,
stains, dints, cuts, and scratches. Damages under this definition voids
any warranty previously implied for the product by PrimeTime Duplication.
Hardware
No refund or replacement credit will be issued after 15 days of the
date when the product is received. All returns on hardware products
are subject to a 15% restocking fee, on account that the product is
in its unused, original packaging condition, if there are missing parts
to the item being returned, PrimeTime Duplication reserves the right
to refuse returns (For Printers if the ink has been used there will
be no store credit or cash back.) Shipping charges are non-refundable.
PrimeTime Duplication is an online retailer and therefore not responsible
for defective merchandise from the manufacturer. The customer is responsible
for shipping charges on returns to PrimeTime Duplication and in return,
PrimeTime Duplication will cover shipping charges back to the customer.
The customer is responsible for risks of loss on all returned shipment.
If the detective merchandise is under warranty it will be repaired or
replaced. On returning defected items, the customer must obtain a RMA
number on all warranty items.
Blank Media
No refund or replacement credit will be issued after 30 days of the
invoice date.
All returns on Blank Media are subjected to a 15% restocking fee. Non-Used
Defective products may be exchanged for the exact or a comparable product
or your account will be credited for the amount of the product plus
tax. The Shipping and Handling fee and any credit card surcharges will
be excluded on any credit that PrimeTime Duplication issues. PrimeTime
Duplication reserves the right to verify the defectiveness of the product
once it is received in order to have the proper credit issued or exchange.
All media that has been Used, Scratched, and Damaged are non-refundable
and will not be replaced. PrimeTime Duplication is an online retailer
and therefore not responsible for defective merchandise from the manufacturer.
The customer is responsible for shipping charges on returns to PrimeTime
Duplication and in return, PrimeTime Duplication will cover shipping
charges back to the customer. The customer is responsible for risks
of loss on all returned shipment. If the detective merchandise is under
warranty it will be repaired or replaced. On returning defected items,
the customer must obtain a RMA number on all warranty items.
When returning a product, please make sure to send it in its original
packaging that it came in including warranty cards, manuals, software
and accessories. The invoice must also be included. The RMA number must
be clearly written on the shipping label. No exchange or credit will
be issued to used or non-original packaging merchandise.
NOTE: PrimeTime Duplication provides excellent customer
service, although customers are not reimbursed for shipping charges
on returned products, PrimeTime Duplication will use every measure to
handle the return process expeditiously.
If the merchandise is damaged upon receiving, PrimeTime Duplication
will file a claim with UPS/FedEx on behalf of the customer for any products
damaged in transit.
Refunds/Replacements will be issued after the claim is approved. Claims
can sometimes take over 15 business days to be processed.
Return options:
• Unopened, unused products returned for credit: In most cases
we will refund your money (less shipping and 15% restocking fee) within
30 days of purchase date on most products. To returned factory-sealed
items, obtain an RMA number (see below) and return using RMA and return
address we provide with that RMA. If an item is not complete and resalable,
the return will not be accepted and a handling fee will be charged.
Some manufacturers will not accept returns for any reason at all.
• Unopened, unused products returned for replacement with another
item: Replacements will be treated as a new order. Follow above instructions
for returning unopened, unused products. Your new order will be processed,
credit card billed and product shipped immediately. Credit for the returned
item will be issued upon receipt and inspection.
Undeliverable Packages
If a shipment is determined by FedEx/UPS undeliverable and returned
to PrimeTime Duplication, customers can request PrimeTime Duplication
to have the product reshipped by paying a new shipping cost, or customers
can request a refund. Refunds will be issued for product cost only.
Original shipping charges will not be refunded.
Disclaimer of Warranties and Limitation
of Liability
PrimeTime Duplication, its website, its operations, all the information
contained within the website, its products sold, and year 2000 compliance
are provided "as-is." PrimeTime Duplication does not offer
and expressly disclaims any kind of warranty, either expressed or implied,
with respect to its website and the use of it, including but not limited
to warranties of title or implied warranties of merchantability and
fitness for a particular purpose. PrimeTime Duplication, its officers,
employees, and representatives will not be held liable for special,
direct, indirect, incidental, consequential, or punitive damages related
to the use of its website, its contents and products sold.
PrimeTime Duplication. is not responsible for any typographical errors
or omissions in regards to pricing, specifications, applications, and
photography in its website. Information contained in the website is
subject to change at any time without notice. Information and warranties
on brand name products is the sole responsibility of the manufacturer.
Manufacturer information is also subject to change at any time without
notice. PrimeTime Duplication takes great effort in ensuring the accuracy
of information and pricing of products on its website, providing customers
a confident shopping experience. However, in the event that typographical
errors causes a discrepancy in product description, compatibility, and
pricing, PrimeTime Duplication has the right to refuse or cancel any
orders placed for the product listed with the incorrect information
and/or price. PrimeTime Duplication reserves the right to refuse or
cancel any such order even if the order has been confirmed and the credit
card charged. In the event that the credit card has already been charged
for the product in question, and order cancelled under this provision,
PrimeTime Duplication will immediately inform the customer and issue
a credit or refund to the credit card account with the amount that was
charged for the item.
PrimeTime Duplication. disclaims all warranties and is not responsible
for the content, its accuracy, validity, and legality of any of the
websites linked to or from the PrimeTime Duplication website.
Pictures show products only. Spindles, cake boxes, CD/DVD wallets, sleeves,
and jewel cases do not include media unless specified on the order.
CDRs are not ideal for mastering; it is recommended that they be used
for duplication purposes only.
The www.primetimeduplication.com website is wholly owned and operated
by PrimeTime Duplication. All materials found on this site such as:
logo, text, content, graphics, icons, images, site design, selection,
assembly and arrangement are the sole property of PrimeTime Duplication.
All materials from this site MAY NOT be copied, reproduced, modified,
republished, uploaded, posted, transmitted, or distributed in any form
without PrimeTime Duplication's written permission and consent. All
products, logos, and brand names are trademarks or registered trademarks
of their respective companies. Violation of copyright, trademark, and
other applicable laws could result in criminal or civil action.
Governing Law and Jurisdiction
Any dispute arising out of or related to these Terms and Conditions
or the sales transaction between PrimeTime Duplication and Customer
shall be governed by the laws of the State of Missouri, without regard
to its conflicts of law rules. Specifically, the validity, interpretation,
and performance of this agreement shall not be governed by the United
Nations Convention on the International Sale of Goods. PrimeTime Duplication
and Customer consent to the exclusive jurisdiction and the venue of
the State Courts of the State of Missouri, St. LouisCounty, to resolve
any dispute between them related hereto, and the parities waive all
rights to contest this exclusive jurisdiction and venue of such Courts.
Finally, the Customer also agree not to bring any legal action, based
upon any legal theory including contract, tort, equity or otherwise,
against PrimeTime Duplication that is more than one year after the date
of the applicable invoice.
Severability: If any provision contained in this agreement
is or becomes invalid, illegal, or unenforceable in whole or in part,
such invalidity, illegality, or unenforceability shall not affect the
remaining provisions and portions of this agreement, and the invalid,
illegal, or unenforceable provision shall be deemed modified so as to
have the most similar result that is valid and enforceable under applicable
Missouri law.
Waiver: The failure of either party to require performance
by the other party of any provision of this agreement shall not affect
in any way the first party's right to require such performance at any
time thereafter. Any waiver by either party of a breach of any provision
in this agreement shall not be taken or held by the other party to be
a continuing waiver of that provision unless such waiver is made in
writing.
Entire Agreement: These terms and conditions, together
with the PrimeTime Duplication's invoice respecting the products ordered
by Customer, are the complete and exclusive agreement between PrimeTime
Duplication and Customer, and they supersede all prior or contemporaneous
proposals, oral or written, understandings, representations, conditions,
warranties, and all other communications between PrimeTime Duplication
and Customer relating to the subject products. This agreement may not
be explained or supplemented by any prior course of dealings or trade
by custom or usage.
